WEBSHOP TERMS AND CONDITIONS
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
Payment
We will withdraw the money from your payment card once the order has been shipped.
Shipping
Customers can expect to receive their order within 1-2 weeks, depending on where the product will be shipped to. Please note that the order will only be sent after the payment has been received. If the order has not been delivered within 2 weeks in total, please contact
webshop@nilsstaerk.dk.
We operate with two standard rates for shipping costs:
- One for EU-orders and one for all overseas and non-EU countries. The price includes 25 % VAT, applicable to all EU citizens.
- For all overseas and non-EU countries orders, products are sold without VAT.
Complaints
Danish citizens
A complaint about a product or service purchased from us can be filed with the Konkurrence- og Forbrugerstyrelsens Center for Klageløsning, Carl Jacobsens Vej 35, 2500 Valby. You can complain to Center for Klageløsning via

EU citizens
Warranty
A 2-year guarantee is granted under the Purchase Act. The right of complaint applies to defects in material and / or fabrication. You can get the item repaired, exchanged, money returned or discounted depending on the specific situation. The complaint does not apply to errors or damage caused by incorrect handling of the product. You must complain in "reasonable time" after discovering the defect / error.

Returns
Our policy lasts 14 days. If 14 days have gone by since your purchase, unfortunately we can't offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. To complete your return, we require a receipt or proof of purchase.
Chancelled orders
Please be aware that order cancellations are subject to a 5% non-refundable fee.
Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Shipping
To return your product, you should mail your product to: Nils Stærk ApS, Glentevej 49, 2400 Copenhagen NV, Denmark. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
PRIVACY POLICY NILS STÆRK
As a data controller, NILS STÆRK ApS is required to protect your personal data when you establish a contract with us as a private supplier or private client, or when you use the other services we provide. We endeavour to ensure that you feel comfortable with our treatment of your data. We process personal data in accordance with this Privacy Policy and current legislation.

2) When do we collect personal data and when do we use it?
We collect data in the following situations:
- When private suppliers establish contracts with us.
- When private clients establish contracts with us or otherwise use the services we provide.
When you, as a private supplier, deliver products to us / sell products through us, we collect a range of data in order to ensure that we can establish contact with you when someone expresses interest in purchasing a product, or when we need to get in touch for other reasons. We collect data, such as your name, address, phone number, and email address. In some cases, we also ask for your date of birth, CPR-number or photo ID. This data is safely stored in our client and product system.
When you, as a private client, express interest in purchasing a product, participating in an event, receiving newsletters, or otherwise using the services we provide, we collect a range of data in order to ensure that we can monitor your relationship with Nils Stærk ApS, as well as to ensure that we can monitor your purchases. We collect data, such as your name, address, phone number, email address, job title, place of employment, artistic interests, relationships with other clients, and a history of your previous purchases and/or sales. This data is safely stored in our client and product system.
Personal data is only processed and stored when it has been willingly shared, such as in connection with a purchase, participation in an event, subscription to our newsletter, and when you contact us by phone or email.
Please note that in some cases, you are required to share personal data such as your name, address, phone number, email address, date of birth, CPR-number or photo ID, as this data may be required for the sale or purchase of a product. We will not be able to establish an agreement regarding the purchase/sale of a product if you refuse to share this data with us.
3) For what purposes do we use personal data?
We use personal data for the following purposes:
- To efficiently handle the purchase/sale of products (e.g. in connection with invoices).
- To set up a profile for you in our client and product system.
- To allow us to efficiently contact you (e.g. in connection with purchase / sale of products / or if an institution (museum, exhibition hall etc.) should wish to borrow and exhibit an artwork owned by you, in this situation we will not pass on information to third party without written consent from you).
- To efficiently respond to queries.
- To send you our newsletter if you have requested to receive this.
- To invite you to events and to effectively plan such events.
- To offer you products and services you have requested.
- For marketing purposes.
- To fulfil our legal responsabilities.
4) On what grounds do we treat your personal data?
We process your personal data as outlined above on the following grounds:
- i. Your consent.
- ii. The processing being necessary in order to honour an arrangement with you or to take steps requested by you prior to the establishment of such an agreement.
- iii. The processing being necessary in order to fulfil our legal responsibilities.
- iv. The processing being necessary to ensure that the data controller or a third party can pursue legitimate interests, unless the registered party’s interests or basic rights and freedoms that require protection of personal data take precedence to this pursuit of interests, namely if the registered party is a child. The pursuit of legitimate interests is operated by the gallery.
5) Are we allowed to send you marketing material?
We would like to send you different marketing material, which we believe may be of interest to you.
We will only send you marketing material if you give us permission to do so and if you have previously opted to receive marketing material from us, you are always free to opt back out.
If you no longer wish to receive marketing material from us, we ask that you either unsubscribe directly through our newsletter or send us an email at gallery@nilsstaerk.dk.
6) When do we pass on your personal data?
We reserve the right to pass on your personal data under certain circumstances. Your personal data may be passed on to: (i) suppliers with whom we work in order to provide you with the services related to your association with Nils Stærk ApS (including service suppliers, such as marketing, services, and support teams; (ii) other third parties, in connection with the purchase/sale of products, invitations to art fairs or other gallery related events, loan of artworks; or (iii) legal bodies if this is required by law.
Your data will only be passed on to the extent, and to the parties, required in order to supply the service requested, e.g. in connection with the creation of a client profile in the client and product system.
7) How long do we store your personal data?
NILS STÆRK ApS stores your personal data for as long as it is necessary in order to provide the services requested, to serve a justified purpose (like monitoring you as a private supplier or client in our client and product system), or to meet the requirements of current legislation. We remove personal data on a continuous basis, deleting data that has served the purpose for which it was stored.
8) Cookies
On our website we use Google Analytics to gather user related statistics. This is anonymous, and no personal data are registered. 9) What are your rights?

You reserve the right to access the personal data of yours that we process. Should it turn out that this data is incorrect or misleading, you reserve the right to request that we amend, block, or delete this data. Furthermore, you are always free to protest further processing of your personal data, as well as to limit further processing of this.
If the processing of your personal data is based on your consent, you reserve the right to rescind this consent. This rescinding of your consent will not affect the legality of processing that occurred before your consent was rescinded.

If your personal data is being used for marketing purposes, you also reserve the right to protest further processing of your personal data for these purposes, including protest against profiling within the context of direct marketing.
10) What happens when we change our privacy policy?
We update this Privacy Policy on a regular basis to ensure that it continues to provide the most accurate information possible, as well as to ensure that it is in accordance with current legislation. This means that this Privacy Policy will be changed and updated on a regular basis. If the Privacy Policy changes significantly, you will be notified by email.
